To support physician and provider independence and patient’s access to healthcare, several CA laboratories, including BillionToOne, had initiated legal action against CDPH regarding their attempt to exclusively provide trisomy screening for all CA residents. On Friday, October 28, 2022, the Court issued an order halting CDPH from enforcing the exclusivity requirement of the CA PNS program.
Under the order, CDPH is currently prohibited from taking any action to prohibit or restrain BillionToOne, and any other otherwise licensed laboratories, from providing cfDNA testing, including screening for trisomies 21, 18, and 13. CDPH is also prohibited from taking any steps to prevent or restrain any California patients or healthcare providers from obtaining cfDNA screening through laboratories not contracted with the CDPH.
